Acceptance of Terms
By downloading, installing, or executing StackEngine CLI (stackengine), or by accessing web utilities at stackengine.dev (collectively, the "Services"), you agree to be bound by these Terms of Service. StackEngine is an independent software project developed and maintained by its founder and principal systems architect (operating as an independent software maintainer pending corporate formalization, and thereafter through its corporate successor). In these Terms, "StackEngine", "we", "us", or "Maintainer" refers to the project maintainer and principal systems architect. If you represent an organization or corporate entity, you represent and warrant that you possess the requisite authority to bind such entity to these Terms.
Three-Tier Architecture & Licensing
StackEngine is delivered across three distinct operational tiers, each governed by specific licensing parameters:
Source-Available local developer utility licensed under Business Source License 1.1 (BSL 1.1), converting to Apache-2.0 on a rolling two-year timeline. Free for internal workstation workflows, pre-commit secret blocking, and local reverse proxying (127.0.0.1). Pre-commit hooks interrupt commits with detected secrets and output manual remediation guidance. Automated PR generation requires Commercial Team.
Commercial team subscription processed 100% self-serve via Stripe. Delivered as a standalone zero-backend CI/CD binary superset authenticated via cryptographic offline licenses. Unlocks the Maker-Checker Remediation Pipeline inside native CI/CD runners: matches sanitized payloads against embedded 500+ expert diagnostic prompt matrices, restores variables in-place, and drafts validated GitHub/GitLab Pull Requests awaiting human sign-off with native runner step logging.
Procured via annual enterprise contracts. Delivered as an offline, zero-egress Docker container with the full 500+ diagnostic prompt matrices, connecting to internal enterprise LLMs (Local Llama / private VPC Azure OpenAI). Authenticated via asymmetric cryptographically signed offline seat licenses with zero phone-home telemetry.
Acceptable Use Policy
You agree not to:
- Circumvent licensing constraints, bypass commercial paywalls, or extract proprietary components of the HybridRedactor engine or diagnostic prompt matrices in violation of the Business Source License 1.1 or commercial agreements.
- Provide competitive commercial hosting of the Community Edition as a managed service without obtaining a separate commercial license.
- Automate denial-of-service attempts or malicious payload injection against StackEngine public endpoints or edge relays.
- Utilize the Services in violation of applicable international export control laws, trade sanctions, or intellectual property regulations.
User Code Ownership & Diagnostic Assistance
USER CODE OWNERSHIP & HUMAN-IN-THE-LOOP PRINCIPLE
StackEngine asserts zero intellectual property ownership, copyright, or licensing claims over your repository code, configuration manifests, or diagnostic payloads. You acknowledge that AI-generated diagnostic patches and Pull Requests are provided strictly as automated advisory assistance. Engineering teams retain exclusive operational responsibility and must independently review, test, and approve all remediation PRs prior to merging into production branches.
Disclaimers & No Warranty
The Source-Available utilities, CLI binaries, and web diagnostic tools are provided on an "AS IS" and "AS AVAILABLE" basis. While the HybridRedactor engine employs multi-stage deterministic tokenization (including Web-Tree-sitter WASM AST extraction and byte-level regex sweeps), StackEngine does not warrant 100% detection of non-standard, obfuscated, or novel credential patterns. StackEngine operates on an opt-in trust boundary and does not intercept unrouted system traffic or bypass channels.
Third-Party API & BYOK Liability
IN BYOK (BRING YOUR OWN KEY) OR UPSTREAM PROXY ROUTING MODES, YOU ARE SOLELY RESPONSIBLE FOR ALL TOKEN USAGE, BILLING ACCRUALS, AND DATA TRANSMISSIONS TO YOUR DESIGNATED LLM PROVIDER. STACKENGINE MAINTAINS ZERO AFFILIATION WITH AND ACCEPTS ZERO LIABILITY FOR EXPENSES OR SANCTIONS INCURRED ON THIRD-PARTY ACCOUNTS.
Absolute Limitation of Liability (The Liability Cap)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STACKENGINE, ITS SOLE PROPRIETOR, INDEPENDENT MAINTAINERS, FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF REVENUE, DATA COMPROMISE RESULTING FROM USER MISCONFIGURATION, OR INFRASTRUCTURE OUTAGES).
NEITHER THE FOUNDER, LEAD ARCHITECT, NOR ANY INDIVIDUAL MAINTAINER SHALL BEAR PERSONAL FINANCIAL LIABILITY EXCEEDING THE MONETARY LIABILITY CAP SET FORTH HEREIN. IN NO EVENT SHALL THE TOTAL, AGGREGATE LIABILITY OF STACKENGINE AND ITS MAINTAINERS ARISING FROM OR RELATING TO THIS AGREEMENT OR THE USE OF THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO STACKENGINE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00). THIS MONETARY LIMITATION CONSTITUTES AN ESSENTIAL BASIS OF THE COMMERCIAL BARGAIN BETWEEN YOU AND STACKENGINE.
Indemnification
You agree to indemnify and hold harmless StackEngine and its maintainers from any claims, damages, liabilities, or legal expenses arising out of your violation of these Terms, your deployment of unverified AI-generated code to production infrastructure, or your breach of statutory compliance obligations in your operating jurisdiction.
Dispute Resolution & Binding Arbitration
StackEngine is operated as an independent software project. These Terms and any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be governed by and construed in accordance with the laws of the State of Delaware (or the principal operating jurisdiction of the Maintainer), without regard to conflict of law principles. Any dispute shall be resolved exclusively through confidential binding arbitration administered by a recognized commercial arbitration provider. Proceedings shall be conducted via remote videoconference or based solely upon written submissions. You expressly waive your right to a trial by jury or to adjudicate claims before a court of law against StackEngine, its founder, or its maintainers.

Architect-Direct Support Model & Legal Notices
StackEngine rejects corporate bureaucracy, sales intermediaries, and tiered call centers. We adhere strictly to an engineering-first operational standard:

- • No Support Middleware: Commercial evaluations, technical security reviews, and enterprise architecture inquiries are reviewed and handled directly by the Founder & Lead Architect—the systems engineer who authored the engine.
- • Asynchronous Engineering Channels: Technical support and vulnerability disclosures are managed strictly through priority asynchronous channels (dedicated GitHub issue trackers or direct email correspondence). StackEngine does not operate real-time phone desks or outsourced support scripts.
- • Zero Hosted Uptime Liability: Because StackEngine is delivered strictly as client-side executables and offline runner binaries running within your private perimeter, StackEngine provides 0 central hosting services and disclaims all hosted uptime or 24/7 on-call availability SLAs.

Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be noted with an updated effective date. Continued execution of the CLI or access to the Services constitutes binding acceptance of the updated Terms.
